SJC Comments Regarding Proposed Rule: Review of State Bar Complaints and Allegations Against Department of Justice Attorneys

On April 3, 2026 the Maine Supreme Judicial Court took the unusual step of commenting as a court to express its concern over a U.S. Department of Justice Proposed Rule Review of State Bar Complaints and Allegations Against Department of Justice Attorneys.

The Proposed Rule would require state bar disciplinary authorities to suspend any investigation of bar complaints against Department of Justice attorneys until the Department of Justice completes its own internal review. The SJC stated that the proposed rule interferes with the Court's own authority and responsibility to address ethical complaints against DOJ lawyers who are members of the Maine Bar.
