Invitation to file amicus briefs
Supreme Judicial Court invites amicus briefs on application of effective date of recent amendments to the Maine Workers' Compensation Act of 1992 regarding appellate jurisdiction
The Maine Supreme Judicial Court, sitting as the Law Court, invites briefs of amici curiae on an issue presented Estate of Gregory Sullwold v. The Salvation Army, Law Court docket number WCB-12-477, scheduled to be argued during the February 2013 session of the Court.
Electronic copies of the petition for appellate review, the response to the petition, and the parties’ filings relating to the employer’s motion to stay Law Court proceedings are available below.
Amici are invited to argue whether, in light of the amendments to the Maine Workers’ Compensation Act contained in P.L. 2011, ch. 647 (effective Aug. 30, 2012), it is the Workers’ Compensation Board Appellate Division or the Court that has jurisdiction to review the Hearing Officer’s decision in this appeal.
An amicus brief may be filed by or on behalf of any individual, entity, or group of individuals and/or entities, without separate leave of the Court. All amicus briefs must be filed on or before January 8, 2013, at the address listed below, and must comply with M.R. App. P. 7(c), 9(e)(1), and 9(f). In addition to filing and serving the required number of copies, amici are encouraged to send a copy of their briefs electronically, as a single pdf file, to email@example.com.
