General Guidelines to Maine Judicial Branch Schedules on State Shut Down Days

All State Courts will be open on State shutdown days, however, on those days the Judicial Branch will not schedule the following:

• Child protective cases
• Family Matter cases that involve an assistant attorney general, or a child support enforcement agent
• Criminal dockets, including non-custodial arraignments, motions and trial

Please note: criminal trials in progress will be suspended until the next non-shutdown day unless constitutional rights are implicated in the suspension. Efforts will be made to schedule trials to avoid such situations.

• Juvenile dockets
• Other routine matters that require the presence of state employees who are not available because of the shutdown day

The courts will handle the following matters on shutdown days:

• Emergency petitions presented by a State agency (such as a request for a preliminary protection order or an emergency, involuntary admission request)
• Matters in which urgent constitutional rights are implicated, including in-custody arraignments and juvenile detention hearings
• Any case type that does not involve a DA, an AAG, or other state workers subject to the state shutdown
