Diversion Program- York County Program Pilot
Foreclosure Diversion Program - York County Program Pilot ProjectThe Foreclosure Diversion Program has been established pursuant to statute P.L. 2009 ch. 402, An Act To Preserve Home Ownership and Stabilize the Economy by Preventing Unnecessary Foreclosures, (effective June 15, 2009) and its purpose is to assist homeowners and lenders in achieving mutually agreeable resolutions to mortgage foreclosure actions through the diversion process. The Supreme Judicial Court has created a pilot project, which begins in York County in August 2009. The pilot project will apply to all residential foreclosures of owner-occupied residences with four or fewer units filed in York County on or after August 3, 2009, and will make mediation sessions available to the parties. Foreclosure actions filed in York County before the effective date of the pilot project may be included in the pilot project in the discretion of the court. Rules for the York County Program Pilot Project can be found in Foreclosure Diversion Program Pilot & Pilot Rules, Me. Admin. Order JB-09-3 (effective August 3, 2009). It is anticipated that the Foreclosure Diversion Program will be launched state-wide in January 2010. Before the state-wide launch it is unlikely that mediation resources will be available to the parties in foreclosure actions outside of York County. Although parties are welcome to request mediation, mediation will be offered only if the court determines that mediator resources are available.
